Forum Peduli Hak Asasi Manusia (FP-HAM) dan dokumentasi pelanggaran HAM masa DOMThe Forum Peduli Hak Asasi Manusia (FP-HAM) and the documentation of human rights abuses under the DOM

The Forum Peduli Hak Asasi Manusia (FP-HAM, Human Rights Concern Forum) was an Acehnese civil-society initiative formed immediately after Soeharto's fall in 1998 to expose human rights abuses committed while Aceh was a Military Operations Area (DOM). Its volunteers travelled to high-risk districts and compiled victim data that helped bring about the lifting of the DOM on 7 August 1998. FP-HAM marks the emergence of civil society as a distinct actor in the history of Aceh's conflict and peace.

Between 1989 and 1998 Aceh, particularly Pidie, North Aceh and East Aceh, was designated a Military Operations Area (Daerah Operasi Militer, DOM). For almost ten years the New Order government deployed tens of thousands of soldiers and police to crush the Free Aceh Movement, and casualties fell not only among GAM but also among civilians. The national media of the period routinely framed victims as members of the “GPK” (Gerakan Pengacau Keamanan, security disturbance movement), while reports of abductions, torture, rape and house burnings circulated by word of mouth without ever being officially recorded.

The fall of President Soeharto on 21 May 1998 opened a political window, yet the DOM status had not been lifted. It was then that a group of Acehnese academics, journalists and activists formed the Forum Peduli Hak Asasi Manusia (FP-HAM) at the initiative of Humam Hamid, a lecturer at Syiah Kuala University. Its moving spirits included Nurdin Abdul Gani, Bukhari Daud, Saifuddin Bantasyam, the journalist Yarmen Dinamika, Colonel Rusli and M. Adli Abdullah. The forum's aim was to expose the human rights violations committed from the imposition of the DOM in 1989 until Soeharto's fall.

FP-HAM's work rested on volunteers who went in person to districts then regarded as the most dangerous, such as Tiro, Bandar Baru, Meureudu, Bandar Dua, Batee Iliek, Lhokseumawe and Peureulak. Participants' testimony shows how modest the movement's logistics were: buses of the ATRA transport company were lent to carry volunteers on condition that fuel was paid for separately, and the cost was later covered by donations from Acehnese living in Malaysia. Coverage in Serambi Indonesia, through the reporting of Yarmen Dinamika, played an important part in mobilising public support despite heavy pressure on the ground.

The results of the FP-HAM volunteers' work, as reported by the daily Waspada (20 July 1999), recorded 1,321 civilians killed, 1,958 abducted or disappeared, 3,430 tortured, 128 women raped and 597 cases of house burning. These figures were higher than the findings of the National Human Rights Commission team led by Baharuddin Lopa, which recorded at least 781 dead, 163 missing, 368 abused, 102 women raped, 98 buildings burned, some 3,000 widows and more than 20,000 orphans. The divergence between the two data sets itself reflects the methodological problems of documenting abuses in a conflict zone: access, the fear of witnesses and the definition of victim categories.

The exposure of these violations, together with the long pressure of students and Acehnese society, forced the central government to lift the DOM. The lifting was announced in person by the armed forces commander, General Wiranto, on 7 August 1998 and was greeted jubilantly in Aceh. President B.J. Habibie then offered the state's apology to the people of Aceh during the independence commemorations of August 1998. Yet the end of the DOM was not promptly followed by thorough judicial proceedings, and the demand for justice for the DOM years became one of the driving forces of the 1999 referendum movement.

Historically, FP-HAM matters because it shows that peace in Aceh was shaped not only by elite negotiations between the government and GAM but also by civil-society work that turned hidden suffering into public fact. Many of its activists went on to take part in later phases, from the Humanitarian Pause of 2000 to post-tsunami reconstruction. The study of FP-HAM is also relevant to debates about Aceh's Truth and Reconciliation Commission, since the data gathered in 1998 form one of the earliest archives of past abuses.

Besides abuses by the security forces, FP-HAM also recorded horizontal violence during the transition. Between 30 October 1999 and January 2000 the forum documented eighteen cases of “people's courts”, in which residents of South Aceh, Aceh Besar, Banda Aceh, Pidie, West Aceh, Central Aceh and North Aceh paraded, doused, shaved and even flogged people accused of adultery, theft, smoking cannabis or not fasting. The data were later used by Rusjdi Ali Muhammad in Revitalisasi Syariat Islam di Aceh (2003), and by Khairil Miswar as a precedent for what he calls mazhab hamok.
