Qanun Aceh No. 8 Tahun 2012 tentang Lembaga Wali NanggroeAceh Qanun No. 8 of 2012 on the Wali Nanggroe Institution

Disahkan Gubernur Aceh, 19 November 2012Signed by the Governor of Aceh, 19 November 2012

This 134-article qanun establishes the Wali Nanggroe as the highest customary leader in Aceh, implementing a provision of the Helsinki MoU. Academic critics highlighted the historical discontinuity of its list of Wali Nanggroe, an article securing Malik Mahmud’s position, selection by a commission without customary communities’ involvement, clauses seen as granting legal immunity, and a structure of councils resembling a ‘shadow government’.

The qanun’s list of Wali Nanggroe names ulama who led the war against the Dutch, who never served as customary leaders as the qanun defines; their tenures also varied from months to decades, unlike the seven-year term set. Article 132(6) was seen as chiefly securing Malik Mahmud as the 9th Wali Nanggroe, while dozens of earlier articles would only apply fully to his successor, expected around 2019. Selection by a Wali Nanggroe Election Commission (Article 70) does not involve the people or customary communities, and Article 17(4–5) requires the provincial parliament’s written consent if the Wali Nanggroe faces legal proceedings.

Critics also pointed to councils around the Wali Nanggroe resembling a cabinet, making the institution look like an ‘Aceh President’ with protocol and budget. Another concern was the possible legalisation of pajak nanggroe through the clause on ‘other lawful sources’ (Article 128) and the role of the Bentara (Article 47). Two models of power were feared to coexist: a governor from the national system and a Wali Nanggroe Institution from the MoU.

Its drafting was read through the concept of the ‘jama‘ah system’: only those who agree join the ranks, while protesters are told to protest the now ‘sacralised’ MoU. The critique traces a paradigm shift from ‘disagree, be killed’ in the conflict, to ‘disagree, be dismissed’, then ‘disagree, protest’, and concludes that the qanun serves the jama‘ah (the group) more than the ummah (the people).
