Undang-Undang Pemerintahan Aceh (UU No. 11 Tahun 2006)The Law on the Governing of Aceh (Law No. 11 of 2006)
2006–kini2006–present
The Law on the Governing of Aceh (UUPA) is the legal translation of the Helsinki MoU into Indonesian national law and serves as the lex specialis governing Aceh’s special powers, from local parties, qanun and the special autonomy fund to village (gampong) government. Two decades after its enactment, the UUPA is seen both as the greatest achievement of the peace and as a new arena of conflict between Aceh and Jakarta. Tensions centre on articles never turned into implementing regulations, on symbols such as the flag and emblem, and on the future of the special autonomy fund after 2027. The revision of the UUPA under way since 2024 shows that the debate now revolves more around percentages than around powers.
The UUPA arose from the need to translate the political agreement of Helsinki of 15 August 2005 into binding legal norms. Through this law Aceh obtained the right to found local parties, to enact qanun that are on a par with regional regulations but rest on its special status, to implement Islamic sharia, to manage part of its natural-resource revenues, to receive a special autonomy fund for twenty years, and to organise its own gampong and mukim government. Legal scholars in Aceh, such as Universitas Syiah Kuala law professor Mawardi Ismail, regard the UUPA as a major achievement of the Acehnese people, since it is not merely a legal framework for special autonomy but also a political instrument regulating power relations between Aceh and the central government, with implications for regional governance, natural-resource management and the national legal system.
From the outset, the passage from the text of the MoU to the text of the law carried a shift in meaning. The MoU’s concept of ‘self-government’ became ‘special autonomy’ in the UUPA, a change of terms that some came to read as a shrinking of the agreement’s spirit. At a focus group discussion of the Kesbangpol Aceh Peace Education Study Team on 13 August 2025, Universitas Syiah Kuala academic Khairulyadi stressed that autonomy in Aceh is never neutral because it is always bound up with the tug-of-war between Aceh and Jakarta. He also warned of a ‘desacralisation of sharia’, when qanun are driven by a normative-dogmatic spirit without solving people’s real problems, and of the tendency to treat the UUPA as a political symbol rather than a development tool.
The UUPA’s central paradox is captured in the title of a book marking two decades of peace: Aceh ‘made peace with weapons, but is in conflict over the UUPA’. Armed conflict gave way to disputes over interpretation, implementation and legal politics. The academic Amrizal J. Prang shows how a law intended as an instrument of peace became a new source of tension with Jakarta. Participants in the Kesbangpol discussion asked whether the slogan ‘UUPA is non-negotiable’ serves the people or only the elite, pointed to the weak attention of central ministries to Aceh’s special status, and urged a review of articles that have never been implemented. Sectoral laws such as the Elections Law were also said to override Aceh’s special provisions.
The clearest evidence of this pattern is the fate of the flag and emblem. The UUPA gave Aceh the right to a regional flag and emblem, but a year later Government Regulation No. 77 of 2007 (10 December 2007) banned regional flags resembling those of separatist organisations, its elucidation naming Aceh’s crescent flag alongside symbols from Papua and Maluku. Aceh Qanun No. 3 of 2013 on the Aceh Flag and Emblem, passed on 25 March 2013, was later annulled not in an open forum or court but by a letter from the Minister of Home Affairs dated 26 July 2016, with an attached decision dated 12 May 2016. The letter only became known to the Acehnese public in August 2019. Its legitimacy is itself contested, because Constitutional Court Decision No. 56/PUU-XIV/2016 had removed the Home Minister’s power to annul regional regulations.
The UUPA’s special status is also tested from within. In 2025 five keuchik (village heads) from various districts petitioned the Constitutional Court to extend their term from six to eight years, in line with the revised Village Law (Law No. 3 of 2024). Critics argued that the petition ignored the UUPA’s standing as lex specialis, which places gampong government under the authority of the Aceh Government, with more detailed rules in Qanun No. 5 of 2003 on Gampong Government and Aceh Qanun No. 4 of 2009 on the election and dismissal of keuchik. If general norms are allowed to seep into the special domain, a legal system built at great sacrifice can be eroded bit by bit.
The revision of the UUPA entered the 2024/2025 National Legislation Programme under the banner of ‘restoring the spirit of the MoU’. Critical analysis notes that Aceh’s demands in this revision mainly concern the size of the fund percentage, not the strengthening of fiscal capacity or of powers that could end dependence. The UUPA thus stands at a crossroads today: it can become a pillar of lasting peace or a source of new political friction, depending on the quality of implementation, responsiveness to people’s needs and fidelity to the original spirit of Helsinki.
