Majelis Adat Aceh dan tiga belas lembaga adatThe Aceh Customary Council and the thirteen customary institutions

Diatur Qanun No. 10 Tahun 2008Regulated by Qanun No. 10 of 2008

Qanun No. 10 of 2008 recognises thirteen customary institutions in Aceh, from the Aceh Customary Council (MAA) to the harbour master (syahbandar), all under the oversight of the Wali Nanggroe exercised through the MAA. The move was part of a post-MoU revival of traditional institutions. Its main weakness is that the list was compiled without historical study of each institution's function, authority and jurisdiction. As a result, the place of customary institutions within contemporary Aceh's power structure remains unclear.

Sebagai tindak lanjut MoU Helsinki, pada 2008 disahkan dua qanun untuk menghidupkan kembali adat: Qanun No. 8 tentang Pembinaan Kehidupan Adat dan Adat Istiadat serta Qanun No. 10 tentang Lembaga Adat. Qanun kedua menyebut tiga belas lembaga: Majelis Adat Aceh, imum mukim, imuem chik, keuchik, tuha peut, tuha lapan, imuem meunasah, keujrueng blang, panglima laot, pawang glee/uteun, peutua seuneubok, haria peukan, dan syahbandar.

Following the Helsinki memorandum, two qanuns were enacted in 2008 to revive custom: Qanun No. 8 on the development of customary life and practice, and Qanun No. 10 on customary institutions. The latter names thirteen institutions: the Aceh Customary Council, imum mukim, imuem chik, keuchik, tuha peut, tuha lapan, imuem meunasah, keujrueng blang, panglima laot, pawang glee/uteun, peutua seuneubok, haria peukan and syahbandar. All are placed under the oversight of the Wali Nanggroe exercised through the MAA, and until a Wali Nanggroe was in place, the MAA carried out that oversight itself.

The critique is sharp: the list is described as mere ‘cut and paste’, lacking any study of these institutions' historical roles, particularly their authority, responsibilities and the demarcation of power within Acehnese society. Under the sultanate, reusam, the everyday customs of society, was monitored by admirals (laksamana) and bentara. That function is now being assigned to the MAA and the Wali Nanggroe, although neither is rooted in Aceh's political history nor performs the role of the Adat Meukuta Alam.

Further tension arises when the ex-combatant hierarchy, from commander to panglima sagoe, is imagined as able to act like the bentara under the symbol of the Wali Nanggroe. Today's panglima sagoe does not perform the functions of the former bentara. At the grassroots, reusam is also being formalised as village and mukim qanuns. Together these developments show a codification of custom that has outpaced understanding of its institutional logic.
